General Terms and Conditions for the Online Shop and Written and Telephone Orders

Areas of Application

Business relations between ÖWI Handels-GmbH, Josef-Hafnerstrasse 4, A2100 Korneuburg and the customer are covered solely by the General Terms and Conditions that are valid at the time of placing an order.

Any other customer-related conditions that are not included in the General Terms and Conditions require written confirmation from us in order to be regarded as valid.

When placing an order, the customer declares that he is in agreement with and accepts these General Terms and Conditions.

Offers and Orders

Our offers are subject to change without notice and apply as long as stocks are available, and our most recent offer annuls any previously existing offers.

The agreement is regarded as valid only after written confirmation of the order has been sent by us.

Only the current conditions of delivery and payment are applicable to a delivery. Any other conditions are only valid if they have been confirmed by us in writing.

Relevant information will be provided in the event that the ordered goods have become unavailable.


All prices are valid as given, although we reserve the right to make price changes as necessary. Freight costs are to be paid by the customer upon receipt of the goods.

We are not responsible for any printing or typographical errors.

Delivery Conditions

Delivery will be made by either a parcel service or a forwarding company, depending on the extent of the delivery.

Freight costs are to be paid by the recipient.

In the case of orders made online, the respective freight costs are clearly specified on the website.

All transportation risks are to be borne by the recipient.

Outside of Austria and Germany, the freight costs (as well as any other secondary costs) will be specified in response to a corresponding enquiry by email, fax or telephone, after which the order will be processed (by email fax or telephone).

Conditions of Payment and Retention of Ownership Rights

In the case of orders made through the online shop, payment is to be effected beforehand, either via a payment service provider or by bank transfer.

Upon agreement, payment may be made within 14 days (with a 2% discount), or within 30 days (net), by bank transfer to our account.

Should the period allowed for payment (30 days) be exceeded, then 10% interest will be added.

The costs of reminders and debt collection will be charged to the purchaser, as far as they are necessary for the purposes of legal action and justifiably correspond to the amount demand, although the purchaser is obliged to pay at most the costs of reimbursing the debt collection agency that has been employed, in accordance with the statutes of the Austrian Federal Ministry for Trade (BMWA) pertaining to the highest rates of debt collection agencies.

The purchaser expressly agrees that, as is usual in business transactions, the ÖWI GmbH may obtain information from credit reference agencies regarding the purchaser’s credit worthiness.

The goods remain our property until full payment has been made. Seizure or further transfer of ownership is not allowed until payment has been effected. The purchaser is obliged to inform us of any interventions that may occur.

We will grant a 3% discount for collection from our market store and payment in cash, or by means of an ATM card.


For any damage that may have occurred during transport we guarantee replacement under the following conditions: The goods have been immediately checked upon arrival, so as to ascertain that they are in order and complete.

The claim is made without delay.

The claim is confirmed by the transport company.

The guarantee is effected in accordance with all legal stipulations.

Right of Withdrawal

“Customers who are consumers in accordance with the consumer protection law, may withdraw from a contract that was concluded at long-distance (or from a declaration of agreement that was submitted at long-distance) within a period of 14 working days, by means of a written declaration of withdrawal or return of the goods. The period of withdrawal begins with acceptance of the delivery of the ordered goods, although Saturdays do not count as working days.  It suffices that the declaration of withdrawal is sent, without any statement of reasons, within the period allowed, Saturdays do not count as working days. In the event of withdrawal, a return of the purchasing price, either as a whole or in part, will only be made step for step upon return of the ordered goods that were received by the purchaser. The address for return of the goods is ÖWI Handels-GmbH, Josef Hafner-Strasse 4, 2100 Korneuburg.

The costs of the return delivery are to be borne by the customer.

The goods should be returned in an unused state that enables them to be resold as new, and in the original packaging. In the case of articles that have been impaired by traces of use, or the packaging of which has been damaged, an appropriate compensation will be charged for the loss of value. The same applies if there are accessories or parts missing upon return of the goods.

There is no right of return in the case of services which, in accordance with the agreement, have begun within the 7-day period allowed for return, and in the case of goods that have been manufactured in accordance with customer specifications, or have been clearly tailored to meet personal requirements, as is the case, in particular, with the application or manufacture of printed elements specially made for individual glass logos.

Place of Performance and Legal Jurisdiction

For both the ÖWI Handels-GmbH, the place of performance and jurisdiction of this agreement is Korneuburg.

Decisions concerning all matters of dispute arising in connection with the agreement are to be resolved solely by recourse to the relevant court locally responsible in the area of the company headquarters of the ÖWI Handels-GmbH.

The agreement is subject to Austrian law, with the exception of the purchasing rights of the United Nations.

Data Protection

You hereby agree that the data listed in the purchasing agreement and the information given by you upon registration will be stored and processed in accordance with the regulations of Data Protection Act. This data will, depending on its respective extent, be used to fulfil the legal regulations for carrying out the payment procedure and for the purposes of customer care.

It is principally excluded that personal information submitted by you on the Internet will be passed on to unauthorized third parties. Only in certain cases might there be an exchange of data with a service company for the purposes of checking credit worthiness.

We request you only to supply such personal information as we absolutely need to process the order. When transferring and storing personal information, the latest encryption technology and access controls are employed in order to protect this data in the best possible way from any intervention by unauthorized parties.

Protection of information relevant to the payment process, for instance credit card data, is of the utmost importance for us. The whole payment process is therefore carried out via a verified payment service provider that uses the best security systems and transfers to us only the results of the transactions. The personal information supplied by you is treated confidentially and such data is used solely for the purposes of processing the order.

There is no transfer of customer information to third parties as data to be used for advertising purposes.

You have the right, at all times, to be granted access, free of charge, to information regarding all the data of yours that has been stored, as well its correction, blocking and deletion (with the possible exception of Österreich Wein).
